1. Acceptance of Terms
By creating an account on or using TripOwl (tripowl.in) — including its website, AI itinerary planner, Travel Stories, and all related features — you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the platform.
These terms apply to all visitors, registered users, and anyone else who accesses or uses TripOwl.
2. Eligibility
You must be at least 18 years of age to create an account and use TripOwl. By registering, you represent and warrant that you are 18 years or older and have the legal capacity to enter into these terms.
3. Account Responsibilities
- You are responsible for maintaining the security and confidentiality of your account credentials.
- Each person may maintain only one account. Creating multiple accounts is not permitted.
- You must provide accurate and truthful information during registration and keep your profile information up to date.
- You are responsible for all activity that occurs under your account, whether or not you authorised it.
- If you suspect unauthorised access to your account, notify us immediately at support@tripowl.in.
4. AI-Generated Itineraries Disclaimer
This is an important section. Please read it carefully.
- Itineraries on TripOwl are generated by artificial intelligence (Google Gemini) and are provided for informational and inspirational purposes only.
- TripOwl does not guarantee the accuracy of timings, entry fees, opening hours, transport schedules, availability, safety conditions, or any other information contained in AI-generated itineraries.
- Users should independently verify all critical information — including but not limited to entry fees, opening hours, permit requirements, travel restrictions, weather conditions, and safety advisories — before travelling.
- TripOwl is not liable for any loss, inconvenience, injury, or damage arising from reliance on AI-generated content. Travel decisions are made at the user's own risk.
- Where itineraries include a "TripOwl Verified" or similar indicator, this means curated local data was referenced during generation. It does not constitute a warranty or guarantee of accuracy.
5. User-Generated Content (Travel Stories)
- Ownership: You retain full ownership of all content you create and publish on TripOwl, including your travel stories, photographs, and comments.
- Licence grant: By posting content on TripOwl, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to display, distribute, reproduce, and promote your content on the platform and in connection with TripOwl's services (e.g., social media promotion, newsletters).
- Your representations: You represent and warrant that you own or have all necessary rights, licences, and permissions to all content you post, and that your content does not infringe upon or violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.
- TripOwl reserves the right to remove any content that violates these Terms of Service or our Community Guidelines without prior notice.
6. Prohibited Conduct
You agree not to:
- Post content that promotes hatred, violence, or discrimination based on religion, caste, race, ethnicity, gender, sexual orientation, disability, or any other protected characteristic.
- Post sexually explicit, obscene, or pornographic content.
- Harass, bully, threaten, or direct personal attacks against other users.
- Post spam, promotional content, fake reviews, or deliberately misleading travel information.
- Impersonate another person, entity, or TripOwl representative.
- Attempt to exploit, hack, reverse-engineer, or abuse the platform, its APIs, or infrastructure.
- Upload images that you do not own or do not have the right to use.
- Use automated tools (bots, scrapers) to access or collect data from TripOwl without express written permission.
- Violate any applicable law, including the Information Technology Act, 2000 and Indian Penal Code provisions.
7. Content Moderation & Removal
- TripOwl may review, moderate, and remove content at its sole discretion if it violates these terms or our Community Guidelines.
- Content reported by users may be temporarily hidden from the platform pending review.
- We aim to review all reported content within 36 hours, in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
- Repeat violators may have their accounts suspended or permanently banned.
- In cases involving unlawful content as defined under Indian law, TripOwl will cooperate with law enforcement authorities as required.
8. Intellectual Property
- The TripOwl name, logo, visual design, user interface, codebase, and curated destination data are the proprietary intellectual property of TripOwl and are protected under applicable Indian copyright and trademark laws.
- AI-generated itineraries are provided to you for personal, non-commercial use only.
- You may not copy, scrape, reproduce, redistribute, or commercially exploit any content, data, or materials from TripOwl without prior written permission.
9. Limitation of Liability
- TripOwl is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- TripOwl is not liable for any travel decisions made based on AI-generated itineraries or user-generated content on the platform.
- TripOwl is not liable for any content posted by users, including inaccurate travel information, offensive material, or intellectual property violations in user stories.
- To the fullest extent permitted by applicable Indian law, TripOwl's total aggregate liability to you for any claims arising out of or relating to your use of the platform shall not exceed the amount you have paid to TripOwl in the twelve (12) months preceding the claim (which, for free-tier users, is zero).
10. Termination
- You may delete your account at any time through your profile settings or by contacting support@tripowl.in. Upon deletion, all your personal data, stories, and uploaded images will be permanently removed within 30 days.
- TripOwl reserves the right to suspend or terminate accounts that violate these Terms of Service, Community Guidelines, or applicable law, without prior notice.
- Upon termination, your right to use the platform ceases immediately. Provisions of these terms that by their nature should survive termination (including limitation of liability, intellectual property, and governing law) will continue to apply.
11. Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and all applicable rules and regulations.
Any disputes arising out of or in connection with these terms or your use of TripOwl shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
